Discrimination of Transgender and Same-sex marriage

Introduction

In many societies, same-sex marriage has been facing enormous opposition. Many criticized this act, and several states have been having a debate on whether to legalese it or not. A lot of discrimination towards transgender and homosexuals has been witnessed in many instances. This has been the case without considering their rights. The question is, have we ever thought about their rights? Why is there hate and unfair treatment towards transgender and homosexual relationships?  Even though there has been varied opinion, same-sex marriage is still a complex and controversial topic worldwide.

When asked, most people believe that homosexuality is a sin. They often referenced this based on bible principles. Because the Bible condemns same-sex marriage, they too oppose it. If the Bible oppose same marriage, then why is the same Bible used to oppress women and keep them off their rights as an equal human being among men? Religion is someone’s belief and it is not based on facts. Most people tie their beliefs in the Bible, forgetting that the Bible contains information of the old century (Bailey R.C.2004). Critiques of same-sex marriage argue that marriage, as defined in the Bible, should be between one man and one woman (Browne, and Jean Nash 59). Altering this natural law will be undermining the marriage institution and also the function of the family woman (Browne, and Jean Nash 59). Proponents argue that everyone deserves equal rights, and a civilized society should not discriminate against people on race, religion, and sexuality, thus denying some sections of individual marriage rights is an act of discrimination woman (Browne, and Jean Nash 63).

Other people oppose same-sex marriage because it does not define clearly the gender role. In her article, May Stephens argues that the gender role does not apply to same-sex marriage. The old idea of gender roles in marriage is very appropriate but, at times, not applicable neither fully embraced not only in same-sex marriage but also in a heterosexual relationship. People have always come with many reasons to oppose same-sex marriage without having considered the right of transgender and homosexuals. Why is it that partners of the same sex must engage in gender role-playing anyway? In this century, sharing house chores, like cooking and cleaning, is always equally divided between the partners in the marriage. This makes both the heterosexual and gays alike, despite the fact one must be a woman and the other a man. (Stephen, 2002).

Same-sex marriage has become a divisive agenda in America, as supporters define marriage from a civil rights perspective. They believe that the institution of marriage is distinct. Marriage is about sexual relations, friendship, love, procreation, mutual responsibility, and childbearing.  For them, same-sex marriage can also have all these aspects. They argue that opposing same-sex marriage means denying gays and lesbian civil rights since unmarried people cannot access favorable tax reliefs; they cannot inherit property (Siegel 1723).   Not legalizing same-sex marriages is denying these people their rights, such as adoption and custody and right to healthcare (Siegel 1723). For them, this is discrimination because, in a same-sex marriage,  people engage in sexual relations and still have children through artificial methods or can adopt the can raise children; thus, they have the right to enjoy equal civil rights(Siegel 1725). Same-sex marriage should not be discriminated against, and they should be treated like heterosexuals. The government needs to uphold the principle of non-discrimination and equality by legalizing same-sex marriage (Browne, and Jean Nash 64). Supporters of same-sex marriage argue that homosexuals have been denied their civil rights because they do not enjoy government privileges like heterosexuals who have legally married, especially health care services and pension benefits.

The California Proposition Eight rewrote its constitution so that heterosexual marriage only should be recognized in California. The Marriage Act defense defined the term Marriage to mean a legal union of a man a woman. The same-sex deserves to be given the right to benefit on their spouse’s insurance cover.

Society considers marriage as a way of making a newborn as per the Bible. The vows during the marriage are about the love between the two, not love because of children. Same-sex marriages can also reproduce and have kids. This happens for lesbian couples; one of the women eggs will be implanted into the others with a donor’s sperm to produce a child. The discrimination of gay marriage may result in a weak community bond. The people come within our community, and discriminating against them may lead to a fragile relationship with them in the same neighborhood. We should not discriminate against same-sex or transgender marriage.

Religious groups in America are equally divided on the issues of same-sex marriage.  Even though the Catholic Church strongly condemns this practice openly opposing same-sex marriage (Djupe, Lewis and Jelen 632). The protestant churches and other religious organization which are non-Catholics have been battling whether to support same-sex marriages since some of their members are gays and lesbians. For a long time, the Catholic Church had been on the lead to oppose same-sex unions as they believe that God institutes marriage. According to Christians, marriage is a lifetime union between one man and one woman who come together to love each other. Marriage is about commitment and having the mutual responsibility of bringing up children and caring for them like God’s children (Browne, and Jean Nash 61).

The idea that same-sex marriages cannot procreate has been a common argument among opponents of this union. They assert that children need to live with both their biological mother and father, and legalizing same-sex marriage will break down families (Browne, and Jean Nash 57).  It is in the best interest that children need to be raised by their parents.  They cite some of the difficulties orphans and single parents and foster parents face in raising children to argue that such unions should not legally be recognized (Djupe, Lewis and Jelen 637). Besides, they believe that if same-sex marriage were to be legal, a child from the same-sex union would be deprived of one of the parents, wither the mother or father; thus, they condemn this practice.

I agree with people being able to express who they are without fear freely. Controversy will continue if the fight against same-sex marriage is still not embraced just because of people’s perception or due to a biblical view. Many also fight this because they claim to maintain dignity and adopt the traditional rule that they found people to be practicing. Despite the results, people are entitled to their point of view concerning same-sex marriage. We all deserve to be happy, and our happiness should not be tied to other people’s perceptions. they wish to marry
