- What is an example of State “Substantive Law?”
Substantive law is found in statutes and case laws, and it refers to a set of rules that defines the peoples and collective bodies’ rights and obligations. They refer to all public and private law categories (Goldman & Cropanzano, 2015). An example of the state substantive law includes, real property rights, contracts, and torts. For example, a state criminal substantive law will define the specific behaviors that are considered illegal and give particular elements that the state court will prove for conviction.
- What is an example of a State Law category?
A state law category is passed by the state legislatures, and its jurisdiction ends at the state boundaries. An example of a state law category is the traffic laws and driver’s license requirements. Each state has its stipulations and laws that drivers should follow.
- Is there both Federal and State Criminal Law? Provide an example of each?
There exist both federal and state criminal laws. An example of federal criminal law is the aircraft hijacking laws that stipulate the elements that make it illegal to hijack an aircraft on the US jurisdiction boundaries. An example of state criminal law is sexual abuse and assault law like rape and sexual harassment.
- What is an example of a Federal Law category?
A federal law category is a law that applies to all states. An example of a federal law category is the Copyright law (17 USA). It has all sets of laws that cover any copyright from mechanical licensing to piracy prosecution. The law category stipulates both criminal and civil penalties for different copyright offenses.
