Do you know the provisions of the 5th amendment? The amendment creates several rights which are relevant to both criminal and civil legal proceedings. The Fifth Amendment also grants convicts a right the grand jury and provides for protection against self-incrimination. I have found it essential that you understand from which amendment of the American constitution emanates. Correct as you refer, no man should be allowed to accuse himself. Another provision that will perhaps add more to your knowledge is the provision of double jeopardy which prevents persecutions for the same charges.

I would say that the self-incrimination ban in courts is the best provision of the 5th amendment clause of the American constitution. Suspects have the right to remain silent until his/her attorney shows up. The Miranda case is one of the saddest exercises of law regardless of whether Miranda was guilty or not. I believe that were it not for the prevention of self-incrimination, some police officers would take advantage of innocent suspects forcing them to plead guilty to speed up the conviction. Right to an attorney should always be granted before any suspect’s case is read in court and no suspect should generally be exposed to defend himself in a court of law.
