The Plaintiff, an aspiring screenwriter, discovered a plot to harm and/or murder Orpah Winfrey by people he considered and knew to be industry associates linked to the Federal Government. He reported to relevant law enforcement authorities, including the Federal Bureau of Investigation (FBI). Instead of responding to the said case and conducting an in-depth investigation to get the evidence about his allegations, the Government law enforcement agencies placed in a criminal profiling list and became under 24-hours surveillance from 2004 and 2008.

 

He lost his opportunity in the writing career. His Book, “On a Hidden Field,” one of the top screenplays in Hollywood by then, was turned into NBC Universal’s 2006-2010 hit TV series “Heroes,” which made a billion-dollar but paid the owner nothing. The Plaintiff was profiled to be an African American hero of unrivaled merits. Based on Byron Allen’s language, the Plaintiff had to be “defamed, discredited, and dismissed.” The Plaintiff’s intentions and primary goal were to inform Ms. Winfrey and relevant authorities about the plan and stop it. However, Ms. Winfrey and others in Hollywood were warned and/or instructed not to communicate with him or his agent, Mr. A. D. Williams.

 

In 2008, the Plaintiff was dismissed from work and became semi-homeless on Berkeley’s streets, California. On the streets of Berkeley, he started an initiative to prevent crimes, and from 2008-2012, he had stopped many crimes including, all-White male pedophile rings. Federal agents always followed every step and watched his actions. After that, the Federal agents started warning the public about Plaintiff and tainted him as a criminal by spreading defamatory images of the Plaintiff to the public. Since he stopped hundreds of crimes in the streets, the federal agents looked at his unblemished record with absolute disdain, given that they felt inferior and started the sickest defamatory campaign.

 

Between October and December 2019, federal agents hacked into the computers of the department of motor vehicles (“DMV”) to change the Plaintiff’s name in the DMV’s records. Federal agents put out “APBs” and used “Manchurian Patsies” to spread false information about the Plaintiff, thereby defaming Plaintiff and violating his right to privacy. On 31 December 2019, a white male attempted to assault Plaintiff at a CVS at the behest of federal agents. Similarly, federal agents deployed a “Manchurian Patsy” to try to assault or murder Plaintiff.

 

The Federal Agents used many women and children and lied to them with the primary aims of entrapping and/or framing the Plaintiff. On 18 January 2020, the Federal agents sent a minor young lady, approximately between the age of 15 and 17 years, for sexual advances. The female minor approached him, stopped in front of the Plaintiff, and suspiciously stared at him. She appeared to be nervous and panic when the Plaintiff ignored her. The Plaintiff noted that over the years, the Federal agents used coercion, fear, fraud, deceit, and menace against children and women claiming to be protecting the streets, with the actual intentions of entrapping the Plaintiff. They conspired with other government agents in the previous defamatory campaigns and entrapment aimed at evicting the Plaintiff from the streets of Berkley, CA. They knew that the Plaintiff was flawless, and his criminal records were spotless, and the best way to taint his records was to entrap him with a female minor and charge him with having sexual intercourse with a minor.

 

On 21 January 2020, the Federal agents sent another African American minor trying to seduce him for sex advances. He reported to the police, but the police altered the report. Federal agents persuaded attorneys for the City of Berkeley to ignore Plaintiff’s warnings regarding white males preying on Bay Area citizens, resulting in one such male killing an African American female BART rider. Similarly, Defendants, together with the BART police, prevented Plaintiff from apprehending a white pedophile. Defendants repeatedly prevented Plaintiff from protecting women and children from rape and murder under his “contract with God,” thereby violating Plaintiff’s right to freedom of religion.

 

On 10 March 2020, the Plaintiff filed a civil action against the Department of Justice (DOJ), the Federal Bureau of Investigation (FBI), and John Doe. On 31 March 2020, the Defendants US Department of Justice (DOJ) and the FBI (Federal Defendants) filed a motion to dismiss the Second Amended Complaint (SAC) of the Plaintiff in its entirety and with prejudice, under Federal Rule of Civil Procedure 12(b)(1). See Federal Defendants’ Motion To Dismiss Second Amended Complaint, 4:19-CV-04906-YGR (2020). The Federal Defendants are arguing that the Plaintiff failed to state the claim, and the Court lacked subject matter jurisdiction over the Plaintiff’s Bivens actions against the Federal Defendants. Id.
