States’ Rights vs. Federal Jurisdiction

The State of Texas has infringed the woman’s right to privacy where it makes it difficult for women to perform an abortion while in the state. I support this is infringing their rights because every woman who decides to perform abortion have all the reasons to do it which can also prevent the baby from suffering. Most cases of abortion occur where the woman have unwanted pregnancy which means the baby was not planned. Forcing the woman to keep the baby may deprive the happiness of the woman and can lead to a more poor society if the baby was not planned for. With legalization of abortion, a safer society is achieved together with peaceful and productive generation. This is why I feel that the State of Texas is infringing on a woman’s right to privacy by making abortion difficult in the State.

The state of Texas action of infringing woman’s right to privacy relates to the U.S Supreme Court decision in Roe v. Wade where they differ on the rights to abortion. According to the U.S Supreme Court decision in Roe v. Wade, a woman has the right to choose abortion in the first months of pregnancy without any legal restriction. The restrictions come in the last trimester of pregnancy where a woman should not conduct abortion. The state of Texas should allow women their rights to privacy of abortion in the first months of pregnancy.

Texas law is not just and fair to women. This is because a woman should have the right to happiness and to their bodies which means if the pregnancy is denying them the happiness, they should have the right to terminate it. The woman may not be prepared to raise the child which will lead to more suffering and poor quality of life to that child.
