Employee Rights.
All employers are mandated by the law to adhere to Employee rights. Most people wake up very early or spend sleepless nights to meet the datelines set by their employers. In a troubled economy like the one we are in currently, you will agree with me that having a job is a blessing. However, despite securing stable employment, it is equally important for employers to respects the rights of its workforce. Many cases involve employee rights, but I’m going to base my argument on the dismissal right of employees.
According to the law, employers are not allowed to dismiss employees without a just cause. Sometimes an employee can commit a serious criminal offence such as being involved in drug traffic; Even so, as an employee you don’t fire them on the spot, there should be a due procedure to be followed maybe it just an allegation. Recently, a friend of mine was unfairly dismissed from his work station checking in 10 minutes within two days in a week. No warning was given to her by the supervisor or anything which suggested the company cannot condone the behaviour. She just arrived one morning, and the manager told her they no longer require her services.
I am certain the company violated the employee dismissal right because they never even bothered to ask the reason behind her late reporting at work. The company could have at least warned her when the behaviour started. This dismissal led her to file for an appeal suing his employer for breach of contract. The court ruled that she was unfairly dismissed which amounted to breach of contract and therefore employer had to compensate for damages. This exactly way to incase an employee right is violated, and employers should keep in mind that if there is a continuance employee violation at your company, no one will be interested in working for you.
