Introduction
The chosen topic for the assignment is Child Abuse, which has been one of the wider concerns all around the world. In most of the countries, the problems of child abuse have been increasingly spreading. Child abuse occurs when a parent or care provider causes injury or death through actions or falling to act. If a child is emotionally hurt, or there is a risk associated with them, then it can also be called child abuse. The types of child abuse occurring in most of the countries are abandon, corporeal mistreatment, sexual abuse, mistreatment and emotional abuse. Therefore, the assignment aims to present the evaluation of the impact of legal and professional issues in the Australian legal context. Further, the project will be elaborating the challenges of implementing policies, procedure and protocols in the environment of health care services. Lastly, the report will be identifying the role of nurses, coded, legislation and documentation f issues for patients at risk.
Impact of legal and professional issues in the delivery of quality patient care
Child abuse includes a wide variety of problems and is recognized as an action by the care provider to deliberately damage the children. A child can be abused in many ways in the course of material areas, orally, sexually, during domestic dysfunction and many more. It is very much important for every country in order to control child abuse as it can turn out to be a severe crime in the court of law. Australia holds the narrowest reporting law regarding child abuse as compared to other countries worldwide. Therefore, the Department of Foreign Affairs and Trade (DFAT) does not have a single level of child abuse or exploitation. The Child Protection Policy is also a part of DFAT’s child protection framework. Therefore, this procedure is dependent on principles that eloquent DFAT’s nil acceptance of child abuse and involver an expectation of the proper management of child protection risks.
However, as per () and most of the research, it has been analyzed that there is limited legal legislation in Australia for the concern of child abuse because of which the delivery of the health care services to the patients fall short in the country. In an Australian legal context, the legislation for the control of child abuse has been weak and comparing Australia with other states or territory; the Australian government could not control the matter due to which the cases have been increasing day by day. In the health care service, the lack of legislation and the legal professional issue has not been adequately effective. Due to the lack of strong and effective law established by the Australian government, the health care service provider has not been able to treat their patients appropriately.
As per (), Australian legal context has helped in the delivery of patient care, but; it lacks in many areas in this field. As per the fact that Australia has limited law for child abuse, people working with children should consider their safety and protection so that they could control an increasing issue of child abuse in the country. However, in terms of health care service, the lack of legal and professional issues regarding child abuse has led the health service provider to face many problems.
Challenges of implementing policies, procedures and protocols
As per the fact that the cases of child abuse have been increasing rapidly, the leading political entities must ensure better use of the policy in order to provide a better service to the patients regarding healthcare. Therefore, the entities might deal with various challenges while implementing the policy in healthcare service. The challenges faced by the health care provider while implementing policies, procedures and protocols are as follows:
The major challenge faced while implementing the established policies, procedures, and protocols are that there is a lack of national leadership. It means that the leadership process that could make sure that the policy is being used accordingly has not been maintained in a higher quality. The healthcare ministry does not conduct effective leadership regarding the services provided in the country.
Another major challenge for this implementation is a lack of integration across health and education, governments and public. While implementing the policy, the health care provider might fall short in terms of knowledge, skills or education to use the policy. The policy might turn to be disadvantageous if the service provider does not conduct the overall policy in the health care service in an appropriate manner.
