Key Terms- History and the Future
Terms for different types of technology used in Court
- Electronic filing
- This term entails the arrangement and filing of court documents by electronic means. I am familiar with this term based on the fact that I have utilized the electronic filing of documents whereby they get placed in the electronic system for easy access by the courts. This is important in the judicial process because it enables safe storage of court documents and compliance by the parties subject to the particular suit.
- Wired Court
- A Wired court refers to a court session conducted through the use of technological devices. This term is new to me, but it appears to be of significant importance to courts when it comes to solving disputes between people that cannot be availed in Court at the same time.

- Disposition
- This term gets defined as a final outcome or current status of a prosecution or an arrest. The most common dispositions include acquitted, which means that one has been established to be innocent of a particular crime by a court of law, and convicted, which means the Court has found one guilty and sentenced them for a particular crime.
- I am familiar with this term because it defines common concepts that are common knowledge about what happens when someone gets arrested. In my opinion, this term is important in the judicial processes because it gets used in the pronouncement of judgment as to whether someone is free or is getting incarcerated.

- Electronic discovery
- This is the discovery process in litigation that gets carried out in formats that are electronic. I am not very familiar with this term, and is important in the judicial process as it helps compile a base of relevant and legally admissible documents that both defense and prosecution use in building their case.
- Online deposition
- This is a statement that is a formal statement made electronically in a court of law. I am not familiar with this term, but I believe it is meant to ensure a decision gets made by the Court and ensure that justice gets served even in instances where the parties to the suit are not in Court.

Proper Names of Alternatives to Trial
- There are various alternative dispute resolution measures that one can take apart from court litigation. Their proper names are as follows
- Arbitration
- This is a process that is private in which parties to a suite agree to solve a dispute out of Court using a neutral third party called an arbitrator. I am familiar with this term because I have been part of an arbitration process before. This term is important for the judicial process as it helps in the faster solving of disputes where litigation becomes time-consuming.
- Negotiation
- This is also an out of court process in which the parties to a suit engage in negotiations in which they make a settlement without litigation. I am familiar with this term based on the fact that I am engaged in constant negotiations in various aspects of life in solving simple disagreements. Negotiation is important in the judicial process because it helps avoid wasting the Court’s time on issues that could be easily resolved out of Court.

- Neutral evaluation
- This is a situation in which a neutral third party evaluates a case or a conflict in helping the parties come to an agreement instead of going to Court. This term is familiar to me based on the fact that in most cases in the resolution of conflicts, a party that is neutral gets used so that a fair decision gets made. This is important in the judicial process as it helps solve problems easier without wasting the Court’s time.
- Conciliation
- This where the parties to a conflict reconcile, and the complainant withdraws the matter from litigation.

- Restorative justice is a way of making a response to a crime, conflict, or injustice, which is aimed at repairing the damage done. An example is in the case of unjust prosecutions, where the victim of the injustice gets restored to the position they would have been in life is the injustice had not happened.
- Mediation between the victim and offender is where the offender and the victim agree on a common solution to a dispute.
- Repair entails fixing the damage caused
- Conferencing entails holding a series of meetings using a specific form of technology for the purpose of coming to a common agreement or decision.

Crimes that may be heard in Court
- Felonies
- This are crimes that are serious and attract incarceration of more than one year. For example, robbery with violence, murder and rape
- Infractions
- This are crimes that are not as serious as misdemeanors and usually entail violations of local ordinances and statutes of states and are usually not punishable by imprisonment. They are usually punishable by community service, fines and other punishments. For example, violations of building permits, traffic offenses etc.
- Misdemeanor
- This is a criminal offense that is less serious and is usually punishable by less than one year of incarceration. For example, social gambling, vagrancy, and drunkenness.
