A binding agreement or contract
A binding agreement or contract can be written, oral, or electronic between buyers and sellers. The availability of internet contracts can be agreed upon electronically; however, frauds have been increasing tremendously that online sellers have faced. Buyers can fraud the seller by receiving the product, then claim that they did not receive or removing some parts and purport that the products do not meet the specifications requested when ordering. However, if one of the parties to the contract coerced or threatened to sign, then in the event the buyer refuses to pay for the goods, it will not be enforceable because it is considered a fraud. Undue influence and duress or providing information online that is misleading or misrepresenting to the buyer, then it is a fraud.
Illegality
Illegality in a contract is where laws of the seller not violated but for the buyer can occur, especially when dealing with online transactions and contracts. If the contract relates to an illegal operation that violates the law, then the parties are engaging in unlawful activities such as gambling over the internet. An illegal covenant is void and cannot be enforced in a court of law if it is breached because it will be a defense of illegality. Furthermore, there will be no remedies or intervening force because it will be deemed that the contract never existed. Gambling over the internet in most countries is illegal; therefore, agreeing to enter into a contract, then it is breached and will have violated the internet contract.
Age of minority
When entering into a contract, it has to be enforceable in case the agreement is breached or violated. Minors who are under the age of 18 cannot enter into a contract; hence, if a contract is entered, it can either be honored or voided. A sales contract online should follow all procedures where a seller presents goods to the seller after the offer and acceptance agreement. In case a minor order for items online or sells them, the online sales agreement is void, and there will be no claims for damages even if false information concerning age. The minors can be defended to have acted not in their right consent; therefore, the contract will not be enforceable or invalid.
