Artificial intelligence and the law

Introduction

Artificial intelligence refers to the use of computerized machines to mimic human actions; the tools process information and respond just like humans. They include robotic figures such as Sophia, the robot. These devices are mainly used in hospitals, airports, and even at home. These machines interpret information and execute orders just as humans do. The devices are being tested and used in our healthcare systems, especially during these coronavirus periods. They are used in performing surgical procedures and also in the routine administration of drugs to patients. They are also used in the banking sector and the chemical industry sector. Artificial intelligence is classified as weak and strong. The weak artificial intelligence includes the use of phones such as personal assistance found on apps. The strong those that carry out a complete task such as those used surgical operations. Some of which have little or no human assistance. With the invention of artificially intelligent products each day, the fair society should, therefore, protect the people, information used, and contain the use of artificial intelligence as they can also be used as weapons. Artificial intelligence has automated the way businesses are carried out. For example, customer relationships of many companies are automated and available throughout the day, including weekends. Companies have apps where robot virtue employees can attend clients. The banking center has also adopted this technology; banks have apps fitted with artificial intelligence to make decisions based on information provided, especially while offering loans and mortgages. (Wright et al., 2018).

Liability of Artificial Intelligence in the European Union

With the rise in emerging technologies in Europe, the need for legal structures has to be adopted for accountability to be met. Liability is one of the legal measures put in place to protect both the producer and consumer effectively. The producer is liable for damages caused by defectiveness. In this perspective, the law defends the consumer for losses caused by artificial intelligence devices due to defectiveness. Importers are also held liable within the European Union on account of sales made by an unspecified producer. In case of injury due to the producer’s defectiveness, the consumer should be protected by law and can legally claim compensation. The protection of consumer properties and his surrounding should be taken to the accord by the producer. The producer is free from liability if only the accident happened due to negligence by the consumer. The law however, does not provide rigid rules to govern technology as it is always dynamic and thus offers that are adaptable to the situation. (Cauffman, 2018)

To what extent can businesses be held civilly liable for cybersecurity breaches in AI products under EU legislation

AI for Europe, COM (2020) summary reviews that artificial intelligence is developing very fast, improving people’s health care, increasing efficiency in the farming technology, and imaging the security of Europeans. It also reviews that several risks can be caused by artificial intelligence. AI for Europe reviews that intrusion on our private lives, gender-based, or several kinds of invasion. It also reviews that most interferences are caused by frustrations, which leads people to involve them in these intrusions for accessing systems. The AI for Europe also states that cybersecurity breaching is caused by several factors such as idleness of the IT professionals and also from people who are very curious about the content that is hidden from them. It also reviews that artificial intelligence has introduced robots that are causing harm to individuals. It states that robots emit strong magnetic waves, which can cause damage to human beings. It reviews that most of the companies in Europe that are operated by robots most of the operators end with health problems. It’s also considered that external people can access most of the robotics through penetration testing. It states that artificial intelligence can be accessed by hackers if there are vulnerabilities in it. Data regime laws of Europe have been set in place to ensure that people are safe in what they are doing and that the violators of the law will face the consequences once the breach the data integrity rights from people.

Brussels (19.02.2020) states that product safety and liability mechanisms are used for safety at the union level. It reviews that in a single functioning market, the probability of the systems being breached usually is low, unlike the markets that are multi-user. It states that civil liability rules assist in ensuring that the people who are experiencing the breaching or attacks get compensated. It reviews that individuals will get compensation from the business sectors that are the causes of the.
