Collaborative Enterprise

This essay will reply to the Demosprudence idea of targeting social movement and legal change, agreeing or disagreeing. I strongly agree with the demosprudence idea that lawmaking is a collaborative enterprise between traditional elites, judges, legislators, lawyers, and ordinary people. This is because any law made affects everybody regardless of gender or ethnicity, provided you reside within that territory that law covers. Demosprudence has also gone further and argued open up of analytic and political possibility to construct and maintain a more dynamic and politically able relationship between legal elites and aggrieved communities which is essential (Guinier 59). However, it has been criticized by Gerald Rosenber, who argues that court decision has minimal effect on social movement, which is very wrong.

Ideal Democracy

I strongly agree that people who are affected by the law should contribute directly in such decision because they have more knowledge on the matter. For instance, abortion law, which affects women and is implemented by men who have an idea on the matter, is very wrong to move globally. In my view, abortion law should be based on women’s beliefs and needs- not according to how men want it today. Ideal democracy portrays well that every individual must take part in any activity affecting them to have comprehensive law catering for every individual as per their needs. For instance, abortion law has no inclusivity and gender sensitivity. Therefore it very unfair for men to make laws concerning abortion when they have little or no idea on matters of abortion and the situation women undergo.
