Debate on the nomination of Brett Kavanaugh

I think the senate should have a bigger role in considering nominees to the Supreme Court, I do not favor the differential role that permits the president full power over the nominations. There should be more active role by the senate, the senate and the president should share power equally when it comes to deciding the federal judges. Most of the nominees by the presidents over the decades have faced controversial oppositions because of lack of experience, or previous life mistakes like sexual assault. It is undeniable that some nominees by the president are qualifies and ready for the work but some are nominated by the president without so much experience on the task ahead of them With the senate having equal power as the president in the nominations, will reduce the controversies and many hearing that the senate have to do. Because the senate will do a background check on the people before they are nominated. Since there are no qualifications stated in the constitution on for the nominee the president can choose whoever they want but with the senate helping in the nomination a better decision of the candidate will be made since it will depend on political judgement.

Brett Kavanaugh is a suitable candidate for the nomination of Supreme Court judge. The senate made the right decision in supporting the president in his nomination. He has technical skills in knowledge of the law in the United States of America. He has past experience as a judge because he has served as the U.S Court of Appeals for Colombia District, with that experience he becomes a very good candidate for the work of Supreme Court judge (Schultz, 2018). His legal reasoning is incredible with his ideas influencing the Supreme over the years.  He also believes in his role as a judge in interpreting the law and not making it.

The allegations against him of sexual assault by the woman may or may not be true. But he denied all the accusations. He agreed to have gone to beer party as a high school student but never assaulted anyone sexually in his life. The FBI investigations and report could not find any evidence to support the claims by Christine Blassey Ford.   Without enough evidence he cannot be convicted of the crime. Considering or assuming he was guilty of the crime, it is a crime that happened when he was 17years in high school, he may have changed and transformed from that behavior. Does an act in high school really disqualify someone for the Supreme Court Justice seat? I do not think so; I think he should just be convicted of the crime and pay his legal debt to our society. Then after the debt he can still sit for the seat, the Americans always talk about forgiving and giving ex-felans a second chance especially if they are changed, I guess this is it.

Nevertheless, some people think that nominating Brett Kavanaugh for Supreme Court judge is the greatest mistake the senate has done during Trump’s reign. Even without evidence against Brett on the rape attempt to Christine Ford, Brett lost his temper during the hearings. Judge should be judicious in temperament and disciplining themselves no matter the line of evidence against them. It was not the case with Judge Brett. The ACLU thinks that the investigations on the sexual assault crime were not fully done. That makes Brett unfit for the nominated position since he is still a suspect (Herman, 2018). The judge in his hearing said that the accusations of sexual assault are a calculated political hit which has been fueled by anger against president Trump winning 2016 elections-revenge for Clinton’. Democrats argued that his statements and testimony raises questions on his political bias and temperament.
