Elements of driving while intoxicated
The player did not commit an offense because he did not know that the fan was selling him a stolen car. Receiving a stolen property only becomes a crime when the buyer is aware buys it while knowing that it was acquired through theft. In this case, the player could not suspect that the car was sold at a lower price since it was stolen because he assumed the seller was a fan who was doing him a favor. However, if the player decided to keep the car after learning that it was acquired through theft, he was guilty of owning stolen property.
Elements of driving while intoxicated
The police officer does not meet the elements of driving a motor vehicle because he is too drunk since we can see him staggering and falling. Driving a car while in that state would risk his life and that of other road users. Considering that the man is too drunk, his blood’s alcohol level is likely to be above the stipulated 0.8 elements. The individual also does not meet the element of using a road/highway because drunkenness may interfere with his ability to make decisions on the road, which is risky to him and his fellow road users.
- I would decide as not guilty. Notably, the driver is innocent because the level of alcohol is 0.2, which is the legal limit. Additionally, the driver depicts no aspect of reckless driving. For instance, the fact that the police officer gets to him means the driver was not over speeding. Moreover, the officer’s decision to arrest the driver seems to be biased because he pursues the fellow basing on the women’s information. Lastly, talking in a slurry manner is not a perfect way of deciding whether one has violated the elements of driving while intoxicated since the person might be having speech challenges.
