Goals of Criminal Law

Although some believe that law at times oppresses the people, a society that has rules would not be a society, but a little more like a jungle for statute serves as a regulator of human interactions and also enforces moral beliefs. Criminal Laws intended purpose is to protect and serve society. Its essential functions help in the protection of society and the basic morals of the people. In America’s early history, the cowboy era saw criminal law dominate. A lot of towns did not have law enforcement leading to lawlessness. If there hadn’t been a restoration of control, the country would not be in existence today (Harris,2018).

Punishment in criminal law has recognized purposes, including deterrence, which prevents future crime by instilling fear to the public or defendant. This is because when the government punishes a defendant, they are less likely to commit another crime for fear of even way worse punishment (Ion,2019. Incapacitation prevents crimes in the future through the removal of a defendant from the society. Rehabilitation makes sure that a defendant’s behavior is altered to avoid future crimes, including rehabilitation centers. Retribution and restitution remove the defendant’s desire for an agreement and punishing the defendant financially to prevent more future crimes.

In community safety, the law ensures that it is possible to resolve conflicts between quarreling citizens in society. It also provides a peaceful and order in the way grievances are handled. It also protects individuals and their properties and also from criminals who would put them in harm’s way physically. Due to property importance in America’s capitalists, a lot of the criminal laws are meant to punish people who steal. Notably, criminal law allows the government to control pollution, collect taxes as well as accomplishing other tasks that are socially beneficial to the community (Crawford et al.,2017).

Harm infliction often causes resentment and apprehension on the part of the ones injured or the ones who witnessed the injuries. The ones affected always seek some revenge and might share what they would want to do in preventing such cases in the future. The law cannot bear to avoid such concerns. In earlier times, the person injured was left to avenge a reoccurrence, or the matter would be taken by a person who was influential in society and owed them some protection. However, in today’s advanced society, there are more sophisticated ways of handling such cases (Robinson et al.,2018).

In modern society during the times of war, executive control locks up people that are suspected of being of hostile associations. Courts tend to show indulgence of a considerable amount during the emergency whither. Notably, some of the examples that are nonmilitarily used include the power in ordering a person committed to trying, to be detained if they are not fit for trial, mandatory detention of illegal non-citizens and powers of involuntary commitment of the ones considered dangerous on the grounds of mental health (Robinson et al.,2018). One way or the other, criminal law, various mechanisms and processes take part in the providence of protection for those accused against the disproportionate punishment. No operation can work with due diligence, guaranteeing each case protection. However, the protection measures offered must be formed at generality’s highest level.
