Dear Sirs,
RE: INSURED: ISA SARL.
ACCIDENT INVOLVING TRUCK ON 1558AG05 ON 11th NOVEMBER 2019.
The above-captioned matter refers.
Please note that we would like to register our displeasure on how you have handled the above subject. It is now six months since we lodged this claim with various promises which have never materialized to date.
In your correspondence dated 27th February 2020, you advised us that the insurers are of the opinion that the vehicle was over-insured. According to us, it is the duty of the insurer to determine the vehicle’s actual value by referring us to a motor vehicle valuer. Further to the above, the insurer was pleased to collect a premium for the value of USD 35,000 in respect vehicle. They should have rejected the consideration and only accepted premium equivalent to the actual value of the vehicle at the inception of cover. Therefore, it is unfair for them to reject our legitimate claim on the above flimsy grounds.
In your email, you further mentioned that the reimbursement is not surpassing the vehicle’s market value. As far as we are concerned, we are not aware of such arrangements as it’s not in the policy documents, and it is not logical to introduce it at this time of claim unless this is embedded in the policy we are not accepting it.
As earlier communicated, should the insurer decide to repair the truck, then it has to comply with the mining companies‘ safety standards since they have very stringent safety measures in place. This is to say that the cabin has to be replaced with a fully dressed one.
Due to inordinate delay in settlement of the subject claim, we have continued to incur costly operation costs as we have had to hire a truck to run our operation. Take note that all this cost will be transferred to the insurer.
Finally, please note we are expecting to receive a revised settlement offer within 14 days from the date of this letter failure to which we might seek redress elsewhere to bring this matter to a conclusion.
