Petitioner is guilty of entering into the marriage without intending to create a real marital relationship for the purpose of gaining an advantage from the marriage.
Petitioner is not a lawful resident of the United States and is currently here under a visitor or work visa. I met the Petitioner on February 2017 through an online dating site. I fell in love quickly and we married shortly after on July 2017. Shortly after we married, the Petitioner changed. She was not the woman I met. We separated several times throughout our marriage and each time we reconciled. Towards the later part of our marriage, around August 2019, I was slowing coming to the realization that she was only using me to gain permanent residence. However, through manipulation and denial, I stayed in the marriage in hopes that things will get better. This realization caused me to go into depression and severe stress that I resorted to other means as a way to suppress what I was going through which I am not proud of, but I am human. When the Petitioner left on 12/15/2020, I decided to move out as well and moved in with my sister in California on 12/26/2020. I also had my phone number changed. I did this intentionally to end the vicious back and forth cycle, to allow myself to move on, and to start my life over. I knew that if I stayed in Texas, she will continue to come by our home to torment and take advantage of me. At the time, I did not have the heart to file a restraining order against her. Since my move, I have not made any attempts to contact the Petitioner. Petitioner’s only communication has been with my sister. I had requested for my sister to communicate with the Petitioner on my behalf. Since this last separation on December 2019, the Petitioner has never asked my sister how I was doing or requested to speak with me. However, on 3/13/2020 Petitioner texted my sister to ask her to tell me that I “taught her more things and will ever miss especially my sarcastic smile”. She proceeded with asking my sister if she can speak with me through her phone as she really wanted to hear my voice to make sure I’m okay. See exhibit A. Petitioner sent these texts after learning on 3/11/20 (from my sister) that the form I filed (form I-130) on March 26, 2018 with U.S. Citizenship and Immigration Services (USCIS) to petition her (Alien Relative) where I sought to have her classified as the spouse of a United States citizen was denied (see attached letter from USCIS). Petitioner knew that I had 30 days from the date of the notice to file a motion to reconsider. The date of the notice was on March 4, 2020. Petitioner sent my sister those texts on 3/13/2020 and after learning that I have moved on and do not wish to speak with her, Petitioner filed for divorce on 4/7/2020. Her texts to my sister was her last attempt to manipulate me into reconciling with her for her own convenience.
