Providing social values

Providing social values is detrimental to American societies. Thus freedom and liberty are crucial aspects of the social `benefits in America. However, there is a conflict on interests between the primary needs of Americans between freedom and liberty on one hand and order and security on the other. All these social values are directed towards achieving morality. Nevertheless, there are differences in which is the best approach to enforcing morality. The corridors of justice provide that these social values can be accommodated all together. Therefore, they incorporated together as ordered liberty. Further, this has created two groups on why morality is crucial and how it should be enforced. The first group is against the use of the law to enforce morality. On the other hand, there is a group that is motivated by the application of the law for enforcing morality. While morality is crucial for any society, there is a need for freedom and upholding human rights even in extreme of observing morality.

By definition, ordered liberty was provided for as a standard of determining the ways of upholding the bills of rights as stipulated in the Fourteenth Amendment. The conflict of interest has on which method is necessary for providing and uphold the ordered liberty. There are two crucial methods to uphold these provisions, including the due process and crime control methods. Societies have a right to express themselves but also observe law and order. Therefore the provisions of the bill of rights, such as the freedom of expression, may be restricted by the need to obtain the ordered liberty in the United States. These provisions are applied in both the society and also through criminal law procedures. For instance, their procedural due process applications in the correctional facilities limit the rights that inmates may enjoy while in the correctional facilities. While many may view the objections as a violation of the First Amendments rights, there is a need for morality in society.

Society strives to achieve order and security. However, these two values can only be achieved when morality is in place. Nevertheless, there are behaviors which undermine the need to enjoy these values within the society. Thus, Americans also strive to enjoy freedom and liberty. Freedom is provided for in the constitution together with the bill of rights. However, liberty needs to live without foreign influence or rule. Since the formation of the united states over two centuries ago, the country has made efforts to excel without foreign influence. However, at the individual level, foreign influence may include the need by the law to have restrictions in certain freedom provisions available in the constitution. For instance, for people held in a correctional facility, their freedom is restricted due to their morality issues. Besides offering them, freedom may undermine others’ security and the need to achieve morality in society. Another example is the need to protect the lives of people working in a correctional facility. A person holding a correctional facility of murder may be a danger to both the facility staff and society. Thus granting them freedom may undermine the need for criminal law and the efforts of criminal justice systems.

Order and security are basic values of the society, and they need to be offered without compromise. Thus while discussing the goals needs to be offered to the society, only one side of the debate needs to be determined. In the provisions of the law, the law enforcement team is meant to enforce the law as a way to achieved order and security. They have to offer security to the taxpayers and also safeguard their property. On the other hand, freedom and liberty are crucial to ensure that people have a chance to conduct themselves in their capacity. This was another basic provision that was in the heart of the founding furthers. Further, as a democratic nation, the citizens have a right to conduct themselves as they wish. Despite these provisions, morality needs to be maintained. According to Wilson (2017), based on the rules of criminal law, contingency must be maintained by preserving humanity and treat others as such than seeing them as objects. Thus maintaining morality remains a priority than offering freedom to society.

Freedom and liberty are typical extensions to the rights that are extended to the people by the constitutions. Therefore they require to be limited in exceptional cases to ensure that those who enjoy freedom do not misuse the provision of the same. For instance, the freedom of expression is one that has been granted by the constitution under the First Amendment. However, their extent when this freedom may be used in a way that contravenes the law. An example is the used of freedom of expression to incite and advocate for violence. When such a provision is upheld, the very role of the law and morality. Order and security prevail when society is at the forefront of observing morality. However, incidences of violence may lead to the destruction of property and loss of lives. Although people are allowed to demonstrate and picket, they have to observe the provisions of laws in expressing their grievances. In such cases, order and security may be maximized to offer security to demonstrating crowds. This ensures that there is order, security, and the provisions of the law are followed.

While order and security may be maximized, by increasing the laws and relevant teams, freedom and liberty are at times limited. Thus they cannot be maximized at the same pace as the order and security. The latter are basic values to society and act to improve and ensure morality in society. Some exceptions limit the need to maximize the freedom and liberty of the people. For instance, based on the definition of liberty, a society should be free from foreign rule. However, when freedom such as freedom of expression interferes with the existing order, the scope of this freedom will be limited. Thus no maximized freedom will be availed to the society. Further, the existence of the federal government limits the need for society to enjoy extreme freedom. People can only enjoy their freedoms to a certain level. Besides, in the case of immoral conduct, freedoms and liberty can be reduced and limited. The latter is witnessed for a person confined to correctional facilities.

The second reason why these two goals cannot be maximized all together is the desire to contain both at achievable levels. That is, order and security are both necessary and can be enforced through increasing necessary personnel. The significance of increasing the factors of the order are security is beneficial to society at all costs. However, taxpayers have to meet the extra cost of hiring the many law enforcement personnel required to achieve the milestone. However, increasing freedom and liberty will have an extreme impact on society. The need to be dependent may lender some individuals immoral and undermines the efforts to achieve order and security. Liberty may be achieved when outside forces have forcefully trying to gain control of the freedom of society. Thus it may be deemed necessary and maximized in the time of need. However, freedom has to be restricted and held to certain limits to ensure that order and security prevail in the security.

Since the two sides of social values cannot be maximized at the same time, priority should be offered to the on with more significance. That is the one that is more beneficial to society. For instance, with the need to maintain morality through the provision of laws, the order and security values are more significant to society than providing extreme freedom and liberty. The provisions of federal agencies such as the Department of homeland security have secured the country from foreign reign or influence. Thus the public does not need the provision of liberty. Nevertheless, the provisions of freedom, as stipulated in the constitutions, need to have exceptions. For instance, the freedom of expression should not offer room for exploitation of speech. Further, issues such as defy advocating for violence should not form part of freedom of expression.

In conclusion, both sides of the discussion are crucial to society. However, order and security are more significant in maintaining morality in society. These are basic to the needs of society and should thus be more advocated. Nevertheless, freedom and liberty were part of the founding fathers’ demands and views in the United States. While both can be maximized, the effect may have critical implications on society. Thus freedom and liberty should be limited in provision since they violate the procedures for order and security. The criminal law should also be applied to ensure that the needs and demands of the society are met. If the country focuses on maximizing freedom and liberty, there will be multiple distractions that will call for increased law enforcement. Further, this may limit the need for morality in society.
