Social worker’s role and legal aspects in residential aged care
Older people are legally vulnerable when entering an aged care facility knowledge of the legal aspects. They are vulnerable because of the stress of moving from home to an absolute new place, the tasks of settling into residential life and the extent to which older people are able to exercise their rights in residential facilities.
Before moving in to a residential aged care facility, several agreements and contracts are needed to be signed between the resident and the service provider. The terms of residential life in the documents will often depend on receiving appropriate information, support and advice from informed intermediaries such as social workers and legal practitioners.
In most cases, older people and their families could not rely on their legal practitioners, allied health or ACAT staff to provide accurate and relevant advice about negotiating the legal aspects of entering a residential facility or the impact of a range of contracts on lives lived in residential facilities. Social workers are the most knowledgeable of the allied health workers. Social workers also equipped with the legal knowledge, including Enduring Power of Attorneys, Advanced Care Directives and the work of the Adult Guardianship.

Many value judgments are made in the treatment process, and social workers must continually be aware that nothing is value free. Spirituality and religion can greatly affect our the values we hold.
Whether professionals are “believers” in the spiritual dimension is important. “Nonbelievers” may not be fully able to accept clients who consider spirituality and religion to be meaningful and useful within the context of their life experiences. A spiritual bias can be just as harmful as all kinds of discrimination, such as racism or sexism.

The Chaplain offers support to people of all spiritual beliefs, and to assist residents, their families and friends in times of need.
Chaplain in aged care facility can help with:

-Bereavement care
– Referral to other services (counselling, bereavement)
