The differences in the degrees and the court personnel such as judges, prosecutors and the defence attorneys

The differences in the degrees and the court personnel such as judges, prosecutors and the defence attorneys, provides high chances for the work in courts to misbehave. These different court personnel can decide to make decisions in distinct ways due to their discretionary powers.

For instance, some prosecutors may decide to act unethically by making inappropriate decisions on which cases should be dismissed and which should go to trial. Theoretically, prosecutors must try to come up with justice rather than looking for a conviction. However, in most cases, most prosecutors are led by their ambitions rather than finding truth. They are also much concerned with plea-bargaining processes whereby innocence is compromised, and the defendant pleads guilty in the transaction of less sentence or fewer charges.

On the other hand, defence attorneys also have the potential to behave unethically. Their significant role is to ensure that the defendants get fair representation and are not denied their due rights. Therefore, their loyalty should be aligned to their clients rather than the public. Sometimes defence attorneys play this role to show their role to reveal their defendants’ innocence. A complete understanding of the facts of the case ensures a strong representation of a defendant by the defence attorney, which facilitates their loyal and confidential relationship.

Like the prosecutors and the defence attorneys, judges are also vulnerable to engage in inappropriate actions. The two significant areas where judges exercise their discretion are sentencing and the interpretation of the law. Judges most notable role is to be impartial whereby judicial integrity and independence are crucial for them not to be influenced by other considerations in their work. Judges should withdraw themselves from cases in which their impartiality is questionable, for example, cases in which they might have financial or other interests.
