Dear circuit court judge

My name is Serge Deutou and I was convicted of a felony offence in 2006. However, I would like to request for expungement on the basis of various grounds that I feel were against my personal rights during and after the trials.  This letter is a formal request to have an arrest removed from my record. Enclosed is a copy of my record and the case number is ——– I was arrested and charged with a felony in 2006.  The following are the major grounds for my expungement request:

  1. At the time of my trial, I was mentally disturbed and thus I made my plea without a clear understanding of the direct repercussions that my plea could have on the final ruling and the long-term impact on my overall wellbeing.
  2. The court did not give me any form of guidance on the possible consequences of my pleas and thus I headed up making what was not only wrong choice of words but also uninformed decisions based on my limited knowledge of the legal language and procedures. One of the direct repercussions that my plea could result to but I was not advised on by the court of on the probability of maximum jail term.
  3. At the time of the court proceedings, I did not have any understanding of the immigration laws as well as the remedies associated such as deportation.  Been a non-citizen in the United States the court ought to have given me a clear understanding of all the possible repercussions of the plea in order to ensure that prior to getting into the plea I have the maximum understanding of the entire process.
  4. I further had no knowledge of other social and monetary costs of my plea such as restitution, restitution fines as well as other associated fees and parole terms.  I would obviously not have entered in the plea if I had been given the proper advice by the court.
  5. My distress during the entire trial period was also greatly impaired and thus I can say I did not enter the plea out of the freewill.

From the above grounds, I hereby seek an expungement from this court. I affirm that all the above grounds are the true description of my circumstance at the time that I entered into this plea and the repercussions have not only been severe but also costly both financially and emotionally.
