The criminal justice system is one of the essential tools that are available in society for controlling any anti-social behaviors. Criminal justice aims at proving the balance between the punishment of the guilty and the protection of the innocent that are guilty. However, there have been racial inequalities and biasness which prevail in the United States criminal justice system. Hence the statement that “racial biasness exists in all the stages of the criminal justice system.” It narrows down to discrimination, which means unfavorable treatment, which is based on race and skin color. Hence, criminal justice is both biased and racist when it comes to blacks and favors whites.
While giving a speech, Sen. Tim Scott illustrated how many times she hand ben pulled over by the police because the police were suspicious of a black citizen driving a lovely car. It is a clear illustration that the criminal justice system is biased on the blacks but not the white. There is such a deep-seated skepticism on the assertion that criminal justice is racial bias. The criminal justice system is systemic racial that it produces racially disparate outcomes regardless of someone’s intentions.
I support that the criminal justice system is biased basing ion supportive date from policing and profiling. There have been increased racial profiling cases where the blacks, compared to the whites, have been pulled over and generally harassed regardless of whether they were on the right and charged with crimes they did not commit. For instance, after a review of 20 million traffic stops, it is evident that the black has twice the chances of being pulled over in comparison to the white even though the whites drive more on average. Further, blacks are more likely to be searched when pulled over, which increases their chance of being guilty. According to the 2017 study, out of over 4.5 million traffic stops by 100 biggest police departments in North Carolina, the ratio between the blacks and the whites being pulled over is 5.4 percent and 3.1 percent. Hence, the criminal justice system is biased and racial to blacks when compared to the whites.
Further, I support the criminal justice system bias when it comes to the blacks and favors the whites more, as shown in the cases of misdemeanors, driver’s license suspensions, and petty crimes. The national study concerning misdemeanor arrests shows that the black arrest rates are twice higher than the white arrest rates on issues like drug possession, theft, vandalism, and disorderly conduct. Further, 30% of black drivers are likely to be pulled over for their automobiles’ mechanical and equipment problems. For instance, from 2001 up to 2013, the blacks and the Latinos where 51 percent population in New York but made up to 80 percent of the people there arrested for misdemeanor arrests and summonses. Hence there is a high degree of biasness and racism in the criminal justice system, as evidenced by supporting data that the whites favored more. An example is Missouri which has been keeping data concerning the traffic stops for over 18years, and it makes it clear that the black has high chances of being pulled over when compared to the white people. With 2017 showing that the blacks have 85percent chances of being pulled up.
