GENERAL RELEASE FORM OF EXISTING CLAIMS
BUGS BUNNY, 1313Mockingbird Lane, Pasadena, CA starting now referred to as Bugs, and MINNIE MOUSE, 123Mickey Mouse Road Disneyland, in the future related to as Minnie while considering agreement as follows:
Minnie was navigating her car in Anaheim, CA, on February 20, 2020, while listening to the radio. She was driving near Disneyland when she heard the news on the Corona Virus and got very upset as they announced the possible indefinite shutdown of Disneyland. In this place, Minnie would occasionally go to get fresh air. It shocked her, and she kept thinking about it as she drove. At 11:00 pm, Minnie went into the intersection at Harbor Blvd and Ball Road. She bumped into another car which belonged to Bugs and was driving it at the moment. Minnie and Bugs got out of their cars, checked the vehicles, and shared the required information and left. Each car had estimated damage. Bug’s attorney contacted Minnie after the accident. Since she was troubled, Minnie thought she caused the accident as she went through a red light. A negotiation with Bugs’ attorneys was done, and Minnie was willing to pay $4,000 to make the matter go away.
Bugs, on his behalf, his assigns, administrators and executors and considering that he received $4,000 from Minnie at the moment would release Minnie, her associates, and successors, familiar or unfamiliar, from any cause of action and damage or injury allegation which was or would occur due to the above incident.
Minnie on behalf of herself, her assigns, administrators and executors, and considering that she paid $4,000 to Bugs, at this moment entirely release Bugs, his partners and any other person and associates familiar or not, from any cause of action or claim due to any damage or injury which sustained, or maybe sustained, due to the above incident.
Both Minnie and Bugs acknowledged that this release applied to all complaints that they had against each other as a result of the mentioned exchange for harm caused to the victim’s property, personal or real, whether those losses or damages are known or not, patent or latent or foreseen or unforeseen.
Each party certified that they understood section 1542 of the civil code as stipulated later, by inserting their initials:
‘A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by his/her, would have mentally affected his or her settlement with the debtor or released party.’
They both agreed to apply the section.
Both victims understood and acknowledged that the importance and outcomes of refusal of Section 1542 of civil code are that any more damages as a result of this incident, no one would be allowed to claim for the losses. Furthermore, both parties acknowledged that they intended these results due to existing damages or injury as of this date but may cause either party not to adhere to this release, without insinuating their lack of knowledge.
They both verify that in signing this release, they have talked to an attorney of choice to seek legal advice, thoroughly read the terms and consequences of this release, and received a detailed explanation of the stated terms from their lawyer.
Both parties have to acknowledge that they have not been intimidated by any representations, promises, or inducements made by their opponents and their associates. Their action is voluntary and out of the free will.
This release shows a disputed claim and does not admit responsibility by either victim for the mentioned incident.
